Il existe aujourd’hui un véritable droit à l’autodétermination du sexe, entre féminin et masculin, toutefois circonscrit dans sa portée. En revanche, le droit interdit l’apposition de la mention « sexe neutre » à l’état civil. Il apparaît aujourd’hui que la mention du sexe à l’état civil est muable. The question of the mutability of sex registration has two aspects: the determination of sex and its consequences. On one hand, there is a genuine right to self‑determination of gender, between male and female, albeit limited in scope. On the other hand, the law prohibits the use of the term “gender‑neutral” in civil status documents. Ainsi le nom et le sexe sont, à l'époque moderne et contemporaine, les deux clés d'authentification des personnes et leur modification devient de plus en plus difficile afin de maintenir l'ordre social qu'ils reflètent. Les répercussions des avancées technologiques sur la vie privée et le contrôle étatique sont examinées, soulevant des questions sur la binarité et les normes sociales. Enfin, elles soulignent les défis du droit à penser l’intersexuation dans l'histoire de l'état des personnes. An historical study of personal status in France since the Middle Ages highlights societal transformations and contemporary challenges. Personal status has been subject to ever tighter control by the Church and the State. In modern and contemporary times, name and gender have become the two keys to authentication, and it is becoming increasingly difficult to change them in order to maintain the social order they reflect. The repercussions of technological advances on privacy and state control are examined, raising questions about binarity and social norms.
